These terms and conditions apply to the “Smack Talk Monthly Giveaway” promotional competitions organised and promoted by For The Love Of Golf (Registration Number 2023/596402/07) (“the “Promoter”), registered office: 176 St Francis Drive, St Francis Bay, 6312. The competitions will be conducted by the Promoter on its Website (the “Website”). The giveaway is referred to as a “competition” in these terms and conditions.

By choosing to enter a competition, a person who participates in a competition (“the Participant”) agrees to be bound by and adhere to these terms and conditions. The Participant acknowledges that he/she has read these terms and conditions and understands them.

Additional terms and conditions applicable to the competition may be displayed on the Website and the Participant agrees to be bound by and adhere to the additional terms and conditions as well.

Only South African entrants, based in South Africa at the time of the competition, may enter the competition. A person must be older than 18 years in order to participate.

There is no entry fee and no purchase necessary to enter this competition.

A competition is not open to:

• any director, member, partner, owner, employee, agent of, consultant to, or anyone associated with or affiliated to the Promoter.
• a supplier of goods or services in connection with the competition.

Entries for the “Smack Talk Monthly Giveaway” competition will close at 10:00 on the last working day of each month.

Entries must be made through the Website. Entries received through any other medium shall not be considered.

To enter, a person must have completed the Monthly Giveaway signup form on the Website and like the Promoter’s Facebook page or follow @ForTheLoveOfGolf on Instagram.

The winner in a competition will be selected by way of a random draw and:

1. will be announced on the Promoter’s Facebook and Instagram pages
2. a confirmation of the win will be sent via email

within 48 hours of the closing time.  In the event the winner does not respond and/or does not provide their contact details and delivery address to the Promoter within 14 of being notified of their win, the winner’s prize will be forfeited.  The Promoter reserves the right but will not be obliged to select a substitute winner.

One prize is available for the winner. The prize will consist of one Smack Talk Golf Shirt and will be sent to the winner within 7 working days of the winner accepting the prize, selecting their smack talk shirt design and providing their contact and delivery address details.

Prizes are not transferrable or redeemable for cash and may not be deferred, changed or exchanged.

Participants may not win a Competition if they have won a Competition promoted by The Promoter within the past 12 (twelve) months. Participants will be eligible to participate in a Competition after the expiry of a period of 12 (twelve) months after the date on which they last won a “Smack Talk Monthly Giveaway” competition.

Prizes may differ from the depictions or descriptions in the competition marketing materials. The Promoter reserves the right to substitute or replace a prize or any item forming part of it.

The Promoter and its employees, officers, contractors, consultants and associates shall not be liable for and the Participant hereby indemnifies and holds them harmless against any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the competition or the acceptance or use of a prize.

The Promoter may in its sole and absolute discretion amend these terms and conditions at any time, by publishing the revised terms and conditions on its website.

In the event of a dispute regarding any aspect of the competition and/or these terms and conditions, the Promoter’s decision will be binding and final and no correspondence will be entered into.

The Promoter reserves the right to cancel, suspend or terminate the competition at any time and without notice to the Participant. If the competition is cancelled, suspended or terminated the Participant will have no claim against the Promoter.

These terms and conditions will be governed by and construed in accordance with the laws of the Republic of South Africa.

The competition is no way sponsored, endorsed or administered by, or associated with Instagram or Facebook.

The Promoter will collect certain personal information (including but not limited to their name and image) relating to Participants for purposes relating to operation of the competition, announcing the winner of the Competition as well as to market and promote the Promoter’s products to the Participants. By entering the Promotion, each Participant consents to such processing and confirm that all data provided by them is truthful and accurate.  Any personal data relating to the winner or any other Participants will be used solely in accordance with current South African data protection legislation and will not be disclosed to a third party.
